Until recently the law of state immunity might have seemed settled and uncontroversial. That is not so. There is a struggle between those who would reduce immunity still further –especially of senior officials such as General Pinochet — and those who would maintain immunity even for outrageous foreign governmental acts. In the age of the International Criminal Court, is Pinochet passé?’
