A High Court decision this morning (7 September) has dismissed an
\napplication of behalf of five asylum seekers seeking to extend
\njudicial review to discretionary Ministerial decisions.<\/p>\n

In a similar application (M61) in 2010, the High Court found that
\nasylum seekers were entitled to judicial review of appeal decisions.<\/p>\n

The High Court judgement means that there is now no legal impediment
\nto the government moving to deport a large number of asylum seekers.<\/p>\n

Around 180 asylum seekers were attached to the case, but the case will
\nalso impact of the fate of perhaps another 100 asylum seekers in
\ndetention centres or in community detention.<\/p>\n

\u201cWe will now be trying to see if there are other possible legal
\nmeasures that can be taken. But are urging the government to see the
\nHigh Court decision as a green light to return people to dangerous
\nplaces like Sri Lanka or Afghanistan.<\/p>\n

\u201cThe dangers of Sri Lanka have been made obvious in recent weeks,\u201d
\nsaid Ian Rintoul, spokesperson for the Refugee Action Coalition. \u201cA
\nrecent report shows that there is a disappearance (mostly abductions)
\nin Sri Lanka are reported at a rate of as disappearances of more than
\none every five days in post-war Sri Lanka. There have been 21
\ndisappearances reported just by Sri Lanka\u2019s English media in the 100
\ndays between April 1st and July 9th 2012.<\/p>\n

\u201cDayan Anthony a Tamil asylum seeker was questioned and intimidated by
\nSri Lankan authorities after he was deported in July. Dayan and his
\nfamily, like the families of other asylum seekers in Australia, are
\nbeing watched by Sri Lankan CID.<\/p>\n

\u201cIn June, this year, a British High Court stopped the removal of
\nTamils because it was considered they were at risk of torture if they
\nwere returned.<\/p>\n

\u201cAnyone who watched \u2018Go back to From Where You Came From\u2019 knows that
\nKabul and Afghanistan are not safe places for asylum seekers,\u201d said
\nRintoul.<\/p>\n

\u201cIn the light of this decision, refugee groups will be stepping up
\ntheir campaigns against deportations.<\/p>\n

\u201cThe government introduced complementary protection legislation into
\nthe Parliament in March this year. If the government is consistent
\nthey will allow all the asylum seekers affected by the High Court
\ndecision to make application for complementary protection. It would be
\ncomplete hypocrisy not to extent that protection to people who arrived
\nbefore March 2012.\u201d<\/p>\n
